General Disclaimer of Terms and Conditions - By scheduling a photo shoot and paying this invoice you understand and agree to these terms and conditions, "both internationally and nationally" and is herby duly noted as a contract that these images can be used for the purpose of MLS advertising and personal website advertising. The image sizing will be no larger than 3550x2440 @150dpi. They may be used for MLS, Web, Postcard or Flyer advertising only and cannot be used to generate income in any way without expressed written permission from JAProPhoto, Additionally, they may not be given to homeowners or other Real Estate Agents without expressed written permission from JAProPhoto or James Allen Photographer. Any magazine or other media of any kind or any distribution is not included or permitted and is subject to usage agreements and possible fees with permission from JAProPhoto - James Allen Photographer. Any violation could be construed as copyright infringement. JAProPhoto - James Allen Photographer holds originator and creator right at all times as allowable by law and can use images as deemed necessary or creatively including but not limited to, advertising, print, sales, web, and distribution without consent at any time. A full copy of an image usage and rights contract is available by request at any time. All images herein stated should be downloaded and or archived by the Client, whether using dropbox, email or other transfer method, it is the sole responsibility of the Client to backup their images. JAProPhoto will backup said images, however, no guarantee or archive duration will be stated or set forth - JAProPhoto, James Allen Photographer is not responsible to provide backup or archived images at any time after the initial transfer to the Client - Cancellations with less than 24 hour notice or Cancelled on the day of the scheduled shoot will be billed as a full shoot, prices of full shoots vary by package and add-on items or agreed to pricing..... A text, email, phone call or Voice mail will be considered a booked contract. Images are taken at the sole discretion of the photographer and cannot be revised if the client is not present during the whole photoshoot, client must be present in person to ask for specifics or provide guidelines.. NOTE - No sky replacement and or any other modifications, alterations, additions or corrections are permitted on any image without express written consent of JAProPhoto - James Allen Photographer. All terms and conditions are in place for our protection and yours. By agreeing to this general disclaimer, it serves as a contract for this transaction and all future transactions.
